Criminal and Regulatory Investigations: Part 3 of 3
If an individual is arrested and charged with a criminal offence or is summoned to appear before the Magistrates Court, they face criminal proceedings with possible serious consequences. All criminal cases commence before the Magistrates Court, regardless of the offences or prosecution authority involved.
Following a first hearing in the Magistrates Court, depending upon the seriousness of an offence, a case may be transferred to the Crown Court for trial or sentence, or may be concluded in the Magistrates Court. Some offences are capable of being tried in either Court, and a defendant may have the choice of which Court their matter progresses through.
Those facing a criminal prosecution potentially face conviction and punishment which could include; imprisonment, fines, linked financial proceedings or community penalties, depending upon the nature of the charges faced.
What do you do if you are arrested and charged or are summoned to appear before the Magistrate Court?
